Anambra Election: How Governor Elect, Charles Soludo Mistakingly Submitted A Wrong Information That May Nullify His Victory

Professor Charles Soludo is the governorship candidate of the ruling party in Anambra State, All Progressives Grand Alliance (APGA). He participated in the November 6 Governorship elections and emerged victorious, after securing the maximum number of votes cast in the polls.

However, the proximity of Professor Charles Soludo and his running mate, Onyeka Ibezim, to be sworn-in as the duly elected Governor of the Anambra State remains skeptical as the decision now lies in the ruling of a Court where a suit has been filed, seeking for the disqualification of Professor Charles Soludo for submitting false information to the electoral body, Independent National Electoral Commission (INEC).

What Was The Mistake Made By Soludo?

When filling the governorship nomination form (Form EC9) that was provided by the electoral body, Independent National Electoral Commission (INEC), Professor Charles Soludo mistakenly wrote that he was contesting for the Aguata 2, when he was asked to state the constituency whose governorship election he is contesting for.

Unfortunately, Professor Charles Soludo did not notice the mistake, until it is being used to challenge his victory as Anambra State Governor-Elect.

Who Sued Professor Charles Soludo?

Two plaintiffs, Egwudike Chukwuebuka and Adindu Valentine have both filed a suit before a Federal High Court in Abuja seeking for the disqualification of Professor Charles Soludo for submitting false information in an affidavit (Form EC9) that was submitted to the Independent National Electoral Commission (INEC).

What Might Have Caused The Mistake?

Yeah, one may wonder what might have confused Professor Charles Soludo to have made the regrettable mistake. However, it is important to note that in the 1999 Constitution of the Federal Republic of Nigeria, a “State” is referred to as a “Constituency” when it comes to governorship elections.

However, who are we to tell whether Professor Charles Soludo was aware of this fact or not before he made the mistake that is currently posing threat at his victory in the recently conducted Anambra State Governorship election.

Can Professor Soludo Still Be Sworn-In With This Mistake?

Actually, this is a completely strange incident, in as much as the democracy of the Federal Republic of Nigeria is concerned. Even, if such mistake has been made by other governorship aspirants, in the past, no one has brought such case to the court to challenge the legitimacy of such candidate, if it has at all happened in the past.

However, the court has the final say on this. It is left to the court to decide whether the case is even has jurisprudence to be given audience or not, considering the fact that filling of Form EC9 and any litigation around it are pre-election matter.

However, what is sure is that whatever the court says in this ruling will be used as antecedent in the future occurrences, where it may find fit.

When Will The Court Deliver Judgement?

According to a story that was published by the PoliticsNigeria, a media platform in Nigeria, the Federal High Court in Abuja, where the suit was filed, has fixed November 30, 2021 for judgment.
